Today we had another example of the unfairness that can result from not making a will. Our client had cared for her mother for years. Mother suffered from dementia, and had never got round to making a will. Although there was a joint account it was clearly for convenience only, and there was no doubt that the money in it belonged to mother.
Our client was left with the unenviable task of splitting the cash equally between her and her brothers and sisters, some of whom had had no contact for decades.
It is possible that action could have been taken if solicitors had been consulted before mother died, despite the dementia, but the exercise would have been costly and the outcome uncertain. If only......Please do not let the subject of a will become an unmentionable in your family.
